It was all very strange the way it played out. As I wrote this today, I asked myself these same questions but knew I didn't have time to do as much digging as I'd like.

I've often wondered how much behind-the-scenes battling was going on over jurisdiction that never made it into the news. There's also a great deal of speculation over "who-knew-what-when" with regard to the video evidence. I didn't mention the fact that LCC students have cards that track their entry/exit into computer labs, and they used that data to determine the video time log (which had no time/date stamp).

Ditto on Crank's comment. Where was LPD? The state police? I realize LCC assumes jurisdiction on crimes, but for murder, at a minimum I would have thought LPD could assume jurisdiction. Tells you something about the arrogance of the LCC Police Department.

Another story here also...the prosecuting attorney allegedly knew about the tape also. Wow, simply incredible.

With all due respect for the LCC Police Department, why in the world would they take the lead on a homicide investigation rather than calling in LPD and/or MSP for assistance? Maybe they did and the article is glossing over that fact, but an agency with no experience investigating a homicide should not take the lead on such matters. This case is a fine example of why.

I am not surprised that the author of the second post has a "problem with all of the obsession" about this case. It is interesting how militant individuals walking out front of a polling location is described as merely "clowinsh" and not intimidation. Not surprising.

As always with an administration committed to "transparency," Holder's DOJ seemingly has yet to set the record straight. If such a clear issue of pre-administration decisions, provide the timeline then just let the situation go. Yet the near silence on the situation is just as interesting as what is said.

At a local polling place, I was asked once to put a jacket on before I even walked in because I had a t-shirt for a candidate I supported. T-shirts bad, clubs good. Interesting. By the way, I had no problem with being asked to put on the jacket. I was thinking about the implications of walking into a polling place wearing a candidates shirt.

Voter intimidation at polling locations should be one of the top priorities for any administration. Wait until the November elections when all of allegations of intimidation by the Tea party starts. You know, all of the grandmoms and accountants can be real goons when they want to be. We’ll see if Holder’s DOJ takes such a passive role then.

Thanks Dr H. Yet I think a more thorough reporting by the Holder administration would be in order. Not being exactly privy to the charges that were brought, it seems the original criminal charges may have been in state court. I have no idea what the situation is here, but even if they were reduced to civil charges it speaks little specifically to questions of civil rights violations.

In the end, there is little doubt that if someone sporting KKK gear carrying a billy club at a polling station would have garnered substantially more attention by the Holder DOJ. I cannot think of anything more important that any attorney general's Office of Civil Rights should focus on than voter intimidation. Does any recall all of the outrage with having police at the polls during the Gore/Bush election? The left was up in arms that was de facto voter intimidation. Yet someone representing the left carrying a billy club? This, as well as what appears to be aggressive behavior? For any DOJ to pass on this is an impressive lack of vigilance as it relates to one of the most basic freedoms we have. No surprise the left cares little about such situations.

That was one of the most controversial parts of the whole statute. As it was passed it did not require any pretextual type of stop, say for a traffic infraction, reasonable suspicion of another crime, etc. The governor signed a bill yesterday which altered that portion of it, so that some sort of pretext is required before the inquiry into immigration status can proceed. Constitutionally this may be enough to make it pass muster with the courts, whereas before I think it would have been quickly invalidated.

AZCAJD - Can you confirm one thing....from your knowledge of the local dicussion and legal understanding of this bill...Is it required that the inquiry into the immigration status is a secondary or a primary reason for arrest? Meaning, there is a mixed opinion in the news accounts I am hearing. Some say that with "reasonable suspicion," officers may inquire into immmigration status. This implies that there does not have to be any other legal pretext to the inquiry. Another set of opinions is that such inquiry can only be made when officers engage based on other legal grounds (e.g., traffic stop). Sort of the seat belt models - Primary or secondary offense statues. any sense of this?
